4. Account Management and Client Money

Account Opening: All accounts are subject to approval and may require additional documentation for verification purposes.

Client Money Protection: Client money is held in segregated accounts with approved banks and is protected under Australian law. We maintain professional indemnity insurance as required by ASIC.

Account Security: You are responsible for maintaining the security of your account credentials and must notify us immediately of any unauthorised access or suspicious activity.

Order Execution: All orders are executed in accordance with our Order Execution Policy. We will seek to obtain the best possible result for you, taking into account price, costs, speed, likelihood of execution, and other relevant factors.

Market Risk: You acknowledge that market prices can move against your position and that you may incur losses. We do not guarantee any specific returns or outcomes.

Fees and Charges: All applicable fees, charges, and commissions are disclosed in our Financial Services Guide and Fee Schedule, available on request.

You agree not to:

• - Use the Platform for illegal activities or money laundering
• - Attempt to gain unauthorised access to our systems
• - Share your account credentials with third parties
• - Use automated trading systems without prior approval
• - Provide false or misleading information

All content, software, and materials on the Platform are owned by MPC Markets or our licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

To the maximum extent permitted by law, MPC Markets shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability is limited to the amount of fees paid by you in the 12 months preceding the claim.

This limitation does not apply to liability that cannot be excluded under Australian Consumer Law or other applicable legislation.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

10. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, we will close your account and return any remaining client money after settling all outstanding obligations.

We reserve the right to modify these Terms at any time. Material changes will be notified to you at least 30 days in advance. Your continued use of the Platform constitutes acceptance of any changes.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
